When the L-1 makes sense
The L-1 is built for multinational employers moving people between related entities. If you have a foreign office (parent, branch, subsidiary, or affiliate) and a U.S. operation, this visa was designed for you.
The advantages over the H-1B are substantial:
- No annual cap, no lottery — file when the business needs it
- L-1A allows 7 years, L-1B allows 5 years
- L-1A leads naturally to EB-1C (the green card path for multinational managers/executives)
- Spouses on L-2 can work with EAD (no separate sponsorship needed)
The two L-1 categories
L-1A — Executives & Managers
For employees coming to the U.S. in executive or managerial capacity. The role must involve strategic decision-making, supervision of professional-level employees, or running a major function.
Best fit: country managers being elevated to regional roles, founders launching U.S. subsidiaries, senior leaders opening a new office.
L-1B — Specialized Knowledge
For employees with distinct expertise about the company’s products, services, processes, or methodologies — knowledge not commonly held in the industry.
Best fit: technical leads with proprietary system knowledge, senior engineers familiar with internal architectures, specialists with rare combinations of skills.
Required prerequisites
- Qualifying corporate relationship — parent/branch/subsidiary/affiliate between foreign and U.S. entity
- 1 year of continuous employment with the foreign entity within the last 3 years
- Genuine role match — the U.S. position must be in executive/managerial or specialized knowledge capacity

Path to permanent residency

The standards align — 1 year of qualifying employment abroad, executive/managerial role, qualifying corporate relationship — and the EB-1C avoids the EB-2/EB-3 backlog that can stretch decades for nationals of high-demand countries.
For senior international hires you want to retain long-term, the L-1A → EB-1C path is often the cleanest route to a green card.
